Terms
and conditions of the "REAL CHANGES FOR REAL WOMEN" Contest organized
by Fajas Salomé / Confecciones Salomé Ltda , which will take place during the
month of June 2020.
Entrants must agree to a number
of legal conditions upon entering the Contest.
The entry of images to the
website implies acceptance of the rules of the contest.
All participants must confirm
that they agree and accept the rules.
By submitting 2 photographs
(the first must show the body or part of the body without a girdle) and (the
second where the body or part of the body is shown with one of our girdles).
The objective is to visualize the change of before and after the use of our
garments. For the second photo you can use any of our garments: shorts, bodies
, bras, pantyhose, sports girdles, post-surgical girdles, shapewear).
For the “REAL CHANGES FOR REAL
WOMEN” Contest, the entrant (“Entrant”) warrants the following:
· That the photos are original and were created solely by the Entrant and
have not been copied, in whole or in part, from another copyrighted or
intellectual property work of another person.
· That the photos do not violate any national law, copyright or other
intellectual property rights and do not plagiarize, slander, defame, disparage,
or otherwise infringe or violate the rights of third parties.
· That the Entrant has obtained the necessary written permission to use
the image of each and every one of the people that appear in the photos.
· That the Entrant has the legal right to submit the Photos in the
Contest.
· That the distribution, reproduction, exhibition and any other use of the
Photos by Fajas Salomé according to these terms and conditions will not
infringe any rights of third parties, including those of any person who appears
in or whose property is shown in the photos.
· That the photos must not be obscene, violent or pejorative of any
ethnic, racial, gender, religious, professional, age group.
· That the photos comply with each of the provisions of these terms and
conditions.
DECLARATIONS AND
RESPONSIBILITIES
1. The Participant declares that he is of legal age.
2. The Participant agrees to hold Fajas Salomé harmless against all claims,
demands, damages, costs, liabilities and causes of any kind that are based on
or arise from the Participant's breach of these terms and conditions or of the
guarantees and/or or statements made by the Participant in accordance with
these terms and conditions.
3. Entrants will enter this Contest at their own risk. Each Participant
must accept that regardless of the result, they will not question the results
of the Contest, nor file any complaint or lawsuit against Fajas Salomé arising
from the conduct of the Contest.
4. The winner will be notified through an online raffle platform, which
will be broadcast live on Facebook: https://www.facebook.com/fajasalomelaoriginal/
5. In the event that notification is returned as undeliverable, or the
winner cannot be verified, or the winner declines or is unable to accept the
prize under the terms and conditions set forth for this Contest, or the winner
is Disqualified for any reason, such winner will forfeit the prize and Fajas
Salomé may select an alternate winner from among all remaining eligible Photos
in accordance with the procedure set forth in these terms and conditions.
6. The Participant agrees that Fajas Salomé has no obligation to return any
of the Photos submitted to the Contest and that it may, at its discretion,
terminate the Contest, without any liability to the Participant.
7. Participants must grant authorization to Fajas Salomé to publish their
name and city of origin in print or in other media related to the Contest.
8. The Participants agree to indemnify, defend and hold Fajas Salomé
harmless from any and all liability to third parties for any damage, loss,
claim, action, demand or damage of any kind arising from or in connection with
the Contest. , including, without limitation, any third party claim for
copyright infringement or a violation of an individual's right to privacy
and/or right of publicity.
9. The Participant accepts that Fajas Salomé has no obligation to provide
financial compensation to the Participant for the Photo(s), whether or not they
are awarded.
10. The Entrant agrees that Fajas Salomé does not act as an agent, publisher
or intermediary of the Photo(s) submitted by the Entrant.
11. Entrant acknowledges that some or all of Entrant's Photos (including
non-awarded Photos) may be published on the following websites:

1. For the avoidance of doubt, Fajas Salomé will have exclusive ownership
of any and all intellectual property rights, including copyrights, to any
publication or media provided using the Photos submitted to the Contest.
2. The winner upon accepting the prize must exclusively assign and transfer
to Fajas Salomé all rights, title and interest in the winning Photos, including
but not limited to all copyrights and trademarks that may have worldwide, for
consideration, the receipt and sufficiency that is recognized here.
COMPETITION RULES
1. Theme The name of the contest is "Real changes for real
women", the invitation is for the participants to show their bodies before
and after putting on a Salomé Girdle.
2. How to participate: Contestants must fill out the form found on our
website. www.fajasalome.com.co , accept terms and conditions
and upload the 2 before and after photos.
*Proper use of photographic
finishing according to industry standards, without abusing editing software and
without adding or removing elements from the original images.
1. The contest is only valid for people living in Colombia.
2. Award: The winner will be notified on June 29, 2020, in the morning
through an online raffle platform. The draw will be broadcast live on Fajas
Salomé's Facebook.
3. Prize: REDUCER KIT consisting of one (1) shaping girdle, one (1) sports
girdle, one (1) reducing gel and one (1) osmotic roll). The winner will be
contacted and will choose the sizes in which they want the garments.
The prize will be sent to the
winner's address in Colombia.
